Definitions
The Subscriber agrees to take the connection provided by M/s Prayag Broadband Pvt. Ltd., Prayagraj (UP) on the following terms and conditions. The following terms shall have the meanings assigned to them:

| CPE / ONU | Customer Premises Equipment / Optical Network Unit — equipment installed by PBPL at the Customer's premises, owned by PBPL and provided on a right-to-use basis only. |
| FUP | Fair Usage Policy — a data threshold above which speeds may be reduced as described in Section 5. |
| OTC | One-Time Charge — a non-recurring upfront payment for equipment and installation as described in Section 7. |
Eligibility
- Fiber plans are available to residential customers only. Commercial or business use requires a separate agreement.
- The Subscriber must be at least 18 years of age and legally capable of entering into a binding contract under applicable Indian law.
- The Subscriber's premises must be located within PBPL's current coverage area (Prayagraj or Mirzapur).
- The Subscriber must provide a valid address, government-issued photo ID, and accurate contact information at the time of application.
- By submitting information and/or contacting PBPL through any medium (phone call, social media, website, etc.), the Subscriber agrees to receive promotional messages and to be contacted by Prayag Broadband.
- Upon activation of services, it is assumed that the Subscriber has read and accepted these Terms and Conditions.
Service Plans & General Conditions
Plan Types
- Fiber (FTTH) Plans: Symmetric upload and download speeds delivered over a dedicated fiber connection. Unlimited data with no FUP. For personal, residential, non-commercial use only.
- Wireless Plans (Prayag Airlink Broadband): Speeds delivered over fixed wireless infrastructure. Subject to Fair Usage Policy (see Section 5). Wireless subscribers may get up to 100 Mbps download speed subject to feasibility and frequency conditions in all plans.
Billing Cycles & Validity
- Plans are available on monthly, half-yearly (6-month), and annual (12-month) subscription cycles.
- Long-term plans are billed upfront and may offer discounted effective monthly rates.
- 1 Month means 30 days.
- Tariff / charges for chosen plans are to be paid in advance and are non-refundable as services are prepaid.
- All mentioned plans are subject to change or discontinuation without prior notice.
- Not all offered prices are available for renewal or across all locations.
- The Tariff Plans/Offers are subject to Guidelines/Directions/Orders issued by TRAI and/or DoT from time to time.
Speed Commitment
The speed committed under a plan is measured at the LAN port. Wi-Fi speed is subject to the Customer's in-house premises coverage and the performance of Customer-owned devices. PBPL does not guarantee Wi-Fi speeds within the premises.
Traffic Management
A Traffic Management Policy applies to all domestic broadband packages. These packages are not suitable for commercial/business usage. Businesses should contact PBPL separately for SME or ILL plans.
04Payment Terms
- Registration charges, activation charges, re-activation charges, installation charges, monthly bandwidth rental charges, advance rentals, GST, and other value-added service charges shall be charged as agreed between PBPL and the Subscriber.
- Besides rentals, additional charges for value-added services shall be payable by the Subscriber on monthly, bimonthly, quarterly, half-yearly, or yearly basis as billed by PBPL.
- GST at 18% is not included in the tariff/charges and is payable over and above the plan charges, as mandated under applicable Indian law.
- Payment is due on or before the renewal date or "Pay by Date" specified in the invoice or account portal. Failure to pay by this date entitles PBPL to disconnect services without reminder.
- All internet services are prepaid. Connections will be automatically closed in case of non-payment. Part payments are not accepted.
- Payment is accepted via UPI, bank transfer, Cash, Cheque, or Demand Draft in favour of "Prayag Broadband Pvt. Ltd." payable at Prayagraj. Outstation and post-dated cheques are not accepted. One cheque/draft per bill. Proper receipt to be obtained by the Subscriber.
- Cheque dishonour charges of ₹500 shall be levied each time a cheque is returned by the bank.
- After disconnection for non-payment, the connection will be restored only on clearance of all outstanding dues (bill amount, surcharge, cheque dishonour charges, reconnection charges). Restoration charges of ₹500 apply from the first day of disconnection. If dues are not paid within 2 months of disconnection, the connection will be permanently closed.
- Rental and minimum service charges for the period the service remains disconnected are payable in all cases. Equipment will be withdrawn upon permanent disconnection as it is the property of PBPL.
Fair Usage Policy (FUP)
Fiber (FTTH) Plans: Truly unlimited. No FUP threshold applies. Subscribers enjoy full plan speeds for the entire billing cycle without any speed reduction.
Wireless Plans: A monthly FUP of 3,300 GB applies. Once this threshold is exceeded in a billing cycle, speeds will be reduced to 4 Mbps for the remainder of that cycle. Full speeds are restored at the start of the next billing cycle.
It is clarified that this benefit is only meant for personal, non-commercial use and is not intended for commercial, enterprise, or special plans. PBPL reserves the right to revise FUP thresholds with 30 days' advance notice. FUP usage data is available in the customer portal at www.myprayagbroadband.com.
06Residential & Acceptable Use
Fiber (FTTH) plans are strictly for personal, non-commercial, residential use. The following activities are expressly prohibited under residential plans:
- Running servers, proxies, VPN exit nodes, or infrastructure services for commercial purposes.
- Reselling or redistributing the Service to third parties in any form.
- Use in commercial establishments, offices, shops, or any non-residential premises.
- Hosting websites, applications, or services that generate commercial revenue.
Additionally, the Subscriber agrees NOT to:
- Communicate, send, transmit, download, or deal in any objectionable messages or communications inconsistent with Indian law over PBPL's network.
- Resort to hacking, cracking, spamming, bulk messaging, defaming, or corrupting any sites/users on the Internet or PBPL's network.
- Indulge in offences defined under the Information Technology Act, 2000 as amended or any other applicable law.
- Use any hardware/software identified as unlawful or that renders network security vulnerable.
Violation of this clause may result in immediate termination without refund, and PBPL reserves the right to report the incident to appropriate authorities. Businesses, SMEs, or subscribers with commercial requirements must contact PBPL separately to arrange a Commercial/SME or ILL Agreement.
07One-Time Charges & Activation
The following one-time charges apply depending on connection type:

- Any one-time charges paid to PBPL at the time of installation are non-refundable once installation is completed.
- PBPL may extend a refund only for the first payment in case of no-feasibility (inability to build the connection to the requested address).
- Online refund may be extended when a transaction is incomplete (i.e., plan not renewed but payment has been generated).
- All advance payments are for the lock-in period and no refund will be made. However, in case of dispute, ₹3,500 + taxes or more will be charged against activation charges; only the balance, after deducting applicable government charges, will be refunded.
- Connection will be installed within a period of 30 days from the date of accepting the CAF, subject to site survey and infrastructure availability.
- Installation and connection charges are non-refundable under any circumstances once work has commenced.
Security Deposit
- A refundable, interest-free security deposit may be required for monthly fiber plan subscriptions at PBPL's discretion.
- The security deposit is waived (zero) for Subscribers who opt for half-yearly (6-month) or annual (12-month) payment cycles.
- The ONU/CPE devices provided by PBPL against a security deposit remain the property of PBPL at all times.
- The security deposit is refundable upon termination of service, subject to settlement of all outstanding dues. It will be returned within 30 working days of service termination and equipment return in good condition.
- Refund will be processed to the bank account provided at the time of registration, or the bank account/wallet linked to the registered phone number. No other bank account will be used for refunds. Cash and cheque will not be used for customer refunds.
- Security refund will not be initiated after 30 days of the last recharge.
- Security deposit is valid only on continuous recharge. If the Subscriber fails to recharge within 15 days of plan expiry, the security deposit will be considered lapsed and forfeited.
Installation & Equipment
PBPL-Owned Infrastructure
All network equipment installed by PBPL — including ONT/ONU devices, antennas, outdoor CPE units, cables, and associated hardware — remains the property of Prayag Broadband Pvt. Ltd. at all times. Subscribers are not authorised to change, transfer, or tamper with such equipment without written permission from PBPL.
Subscriber Responsibilities
- The Subscriber must ensure safe and reasonable access to PBPL-owned equipment for maintenance, upgrades, or retrieval.
- The Subscriber shall immediately inform PBPL of any damage, loss, or theft of PBPL equipment and shall be liable for repair/replacement costs.
- The Customer shall not change, alter, or modify the CPE installed at their premises without prior written approval from PBPL. Unauthorised modification will result in immediate disconnection/de-activation.
- Earthing and provisioning of spike/lightning arresters must be arranged by the Customer at their own premises.
Equipment Fault & Repair Charges

Any damage to tower or equipment in a client's complex will be recovered from the Customer. PBPL will restore CPE-related service problems at no cost to the Customer, provided the malfunction is not due to Customer mishandling.
10Refund Policy
- All services are prepaid. Charges paid are generally non-refundable.
- PBPL may extend a refund for the first payment only in case of no-feasibility for building a new connection to the requested address.
- An online refund may be extended when an online transaction is incomplete (plan not renewed but payment has been generated).
- Security deposit refunds will not be initiated after 30 days of the last recharge. Equipment must be returned to a person appointed by PBPL in the same condition as received.
- In case of dispute, ₹3,500 + taxes or more may be charged as activation/processing charges; only the balance after deducting applicable government charges will be refunded.
Termination
Termination by Subscriber
A Subscriber may terminate the Service by providing at least one month's written notice to PBPL via email or through the customer portal. Prepaid amounts for unused plan periods are not refunded except at PBPL's discretion on a case-by-case basis.
Termination by PBPL
PBPL reserves the right to terminate or suspend the Service immediately without liability in the following circumstances:
- Non-payment of dues — connection will be automatically closed for non-payment; restoration requires full clearance of dues.
- Breach of any provision of these Terms and Conditions.
- Misuse of the Service including illegal activity, spamming, hacking, or network abuse.
- Tampering with PBPL equipment or configuration without prior written approval.
- Providing false information at the time of subscription.
- Violation of any act in force by illegal usage of PBPL services.
Equipment Return
Upon termination — by either party — all PBPL-owned equipment must be returned in good working condition within 7 days. Failure to return equipment will result in costs being deducted from the security deposit or charged separately.
DOT/Regulatory Termination
The Department of Telecommunications (DoT) reserves the right to take over the entire services and network of PBPL, or to revoke/terminate/suspend the license in the interest of national security or emergency. The Subscriber shall not sublet the Services provided by PBPL.
12Limitation of Liability
- PBPL is not liable for any loss, damage, or inconvenience arising from service interruptions, outages, or degraded performance caused by force majeure events — including natural disasters, power failures, civil unrest, earthquake, law and order disturbances, terrorist activities, riots, or acts of God. In such events, a rebate in rentals will be provided as per applicable rules, but neither party is entitled to terminate the arrangement.
- PBPL will not be liable to give any rebate or compensation for billing due to faults in lines, technical faults in the control room, or unforeseen events, except as provided by applicable rules. Any claim for rebate must be made in writing; the discounted amount will appear in the next bill.
- PBPL is not liable for any indirect, incidental, consequential, or punitive damages arising from use or inability to use the Service.
- PBPL's maximum aggregate liability for any cause of action shall not exceed the value of one month's subscription fee paid by the Subscriber for the applicable plan.
- PBPL does not warrant uninterrupted or error-free service and makes no guarantees regarding third-party content or services accessed via the network.
- PBPL is not liable for any act of its agents or business associates outside the scope of Services.
PBPL Rights & Network Monitoring
PBPL and its associates reserve the right to:
- Visit the Customer's premises and verify the validity of stated information at any time during the service contract period, unhindered and without prior notice.
- Take corrective action in case of misuse of the Service or breach of applicable law — including blocking offending traffic, terminating Service after due notice, and reporting to appropriate authorities.
- Monitor utilisation patterns and traffic for regulatory compliance.
- Introduce, withdraw, or extend any Scheme(s) at its discretion with specific validity periods.
- Modify or withdraw any promotional campaign along with offered gratification without notice. The basis for selection of winners under any promotional campaign is at the Company's sole discretion.
- Monitor and apply policies to any and all transmissions via the Network and Services, and to determine whether transmissions violate this Agreement or prevailing law.
Regulatory Compliance
Government Levies
Any variation in government levies and charges by DoT shall be applicable to the Subscriber's account without prior notice. The Customer shall also pay to PBPL any regulatory fees charged to PBPL by any Government authority in connection with the Services.
"GST Act" shall mean any Act imposing or relating to the imposition or administration of tax by State or Central Government under SGST, CGST, or IGST.
Public IP Address
Public IP address allocation will be as per the policy of APNIC (Asia Pacific Network Information Center), IRINN, and PBPL — subject to availability. IP addresses will be allocated as per PBPL policy and product specifications. Static IP addresses are not available on residential plans and require a separate SME/Business agreement.
Wi-Fi Authentication
Any Wi-Fi connectivity deployed by the Subscriber must be activated only after it is registered for centralised authentication with PBPL, in compliance with DoT Letter No. 820-1/2008-DS Pt. dated 23-02-2009.
Voice over Internet Protocol (VoIP)
If the Subscriber uses Voice over Internet (VoIP), they agree to comply with the following as per the ITSP license:
- Internet telephony may only connect: PC to PC (within or outside India); PC in India to Telephone outside India; IP-based H.323/SIP Terminals to similar terminals within or outside India.
- Voice communication to/from any PSTN/ISDN/PLMN number using national numbering plan is not permitted.
- Originating voice communication from a Telephone in India is not permitted.
- Terminating voice communication to a Telephone within India is not permitted.
- Establishing a gateway between the Internet and PSTN/ISDN/PLMN in India is not permitted.
- Addressing scheme for Internet telephony shall conform to IP Addressing Scheme of IANA, exclusive of the National Numbering Scheme.
IT Act Compliance
The Customer agrees to comply at all times with all applicable laws, bye-laws, rules, regulations, orders, directions, and notifications of the Government/Courts/Tribunals/DoT/TRAI, and the Information Technology Act, 2000 as amended. The Customer shall provide PBPL with all information and cooperation as reasonably required. The Customer undertakes to indemnify and hold PBPL harmless against any liability arising from the Customer's acts of omission or commission.
15Privacy
PBPL collects and processes Subscriber data (including personal identification, contact information, and usage data) strictly for the purposes of service delivery, billing, and regulatory compliance.
- Subscriber data will not be sold or shared with third parties for commercial purposes.
- Data may be disclosed to regulatory or law enforcement authorities as required by applicable Indian law, including the Information Technology Act, 2000 and its rules.
- PBPL retains usage logs for the period mandated by applicable regulations.
- Subscribers may request access to or correction of their personal data by contacting support.
Changes to Terms
PBPL reserves the right to modify, amend, or replace these Terms and Conditions at any time. Changes will be communicated through:
- A notice published on the ISP's website (www.prayagbroadband.com), and/or
- An SMS sent to the registered mobile number of the Subscriber.
Such posting will be deemed to have been read by the Customer. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. Subscribers who do not agree may terminate as per Section 11. All charges are subject to revision by PBPL from time to time and are subject to modifications/directions/instructions of DoT or the Government as may be applicable.
17Governing Law & Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms, the Service, or the subscriber relationship shall be subject to the exclusive jurisdiction of the courts located in Prayagraj, Uttar Pradesh.
In case of any dispute regarding the arrangement, the decision of Prayag Broadband Pvt. Ltd. shall be final and binding on the Subscriber. Any dispute arising between PBPL and the Subscriber for non-payment of outstanding dues shall be referred to a single arbitrator appointed by PBPL, whose decision shall be final and binding on both parties. The parties agree to attempt to resolve disputes amicably through good-faith negotiation before resorting to legal proceedings.
